Action in the district court for Hennepin county to recover the amount of a deficit existing in a C.O.D. account claimed to
be due plaintiff as part of a business purchased by her from defendant, which deficit plaintiff alleges was caused by defendant's
fraudulent diversion of funds therefrom. At the close of plaintiff's case the court, Theodore B. Knudson, Judge, granted defendant's
